1. Agreement to Terms

By creating an account or using the MyDirector AI service (the "Service"), operated by MyDirector AI Inc. ("MyDirector AI," "we," "us," or "our"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and MyDirector AI Inc.

2. Eligibility

You must be at least 18 years of age to use the Service. By creating an account, you represent and warrant that:

• You are at least 18 years old
• You have the legal capacity to enter into a binding agreement
• You are not prohibited from using the Service under any applicable law

If we learn that a user is under 18, we will terminate their account and delete their data immediately.

3. Description of Service

MyDirector AI is an AI-powered content strategy platform that helps content creators and business owners develop viral content ideas through:

• AI Interview Sessions — real-time video conversations with an AI director that helps you discover content hooks and storytelling angles
• Instagram Research — automated analysis of public competitor content to identify viral patterns and trending topics
• Content Strategy Tools — notes, insights, and research summaries to guide your content creation

The Service uses artificial intelligence (including large language models) to generate insights, suggestions, and analysis. See Section 8 for important disclaimers about AI-generated content.

4. Account Registration and Security

4.1 Account Creation

To use the Service, you must create an account with a valid email address and password. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your password
• Promptly notify us of any unauthorized use of your account
• Accept responsibility for all activities under your account

4.2 Account Tiers

The Service may offer different account tiers (e.g., free, beta, paid) with varying feature access and usage limits. We reserve the right to modify tier features and limits at any time with reasonable notice.

4.3 Email Verification

You must verify your email address to access certain features. We use email verification to confirm your identity and protect your account.

5. Acceptable Use

You agree NOT to use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Upload content that is illegal, harmful, threatening, abusive, defamatory, or obscene
• Impersonate any person or entity
• Attempt to gain unauthorized access to the Service or other users' accounts
• Use automated scripts, bots, or tools to access the Service (except as explicitly permitted)
• Circumvent usage limits, rate limits, or access controls
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to develop a competing product or service
• Interfere with or disrupt the Service's infrastructure
• Upload malware, viruses, or harmful code
• Scrape, harvest, or collect data from other users

Violation of these terms may result in immediate account termination without notice.

6. Instagram Integration

6.1 Authorization

When you connect your Instagram account, you authorize us to access your public profile metrics (follower count, following count, post count) via the official Instagram Graph API. We do NOT access your direct messages, stories, or post content.

6.2 Competitor Research

The research feature analyzes publicly available content from Instagram accounts you designate as "competitors" or "inspiration." This analysis is based on publicly accessible information only.

6.3 Disconnection

You may disconnect your Instagram account at any time through the app settings. Upon disconnection, your Instagram access token is immediately invalidated and deleted.

6.4 Instagram's Terms

Your use of Instagram data through our Service is also subject to Meta's Platform Terms and Instagram's Terms of Use. We are not responsible for changes to Instagram's API or policies that may affect Service functionality.

7. AI Interview Sessions

7.1 Recording Consent

When you start an AI interview session, you acknowledge and consent to:

• Your audio and video being recorded for the duration of the session
• The recording being stored securely in your account
• Your audio being processed in real-time by AI language models to generate responses
• Session insights being stored for use in future sessions (conversation memory)

7.2 Session Limits

Interview sessions are subject to:

• A maximum duration of 2 hours per session
• Monthly session limits based on your account tier
• Rate limiting to prevent abuse

7.3 Session Recordings

Your interview recordings are:

• Stored securely and accessible only to you
• Retained until you delete your account
• Subject to a 90-day post-deletion retention period after account deletion
• Never shared with third parties or other users

8. AI-Generated Content Disclaimer

8.1 No Guarantee of Accuracy

The Service uses artificial intelligence to generate content suggestions, research insights, and strategic recommendations. AI-generated content:

• May contain inaccuracies, errors, or hallucinations
• Should not be relied upon as professional advice (legal, financial, medical, or otherwise)
• Is provided "as-is" without warranties of accuracy or completeness
• Should be reviewed and verified by you before use

8.2 No Guarantee of Virality

MyDirector AI provides content strategy suggestions based on AI analysis of public data. We do NOT guarantee that any content created using our suggestions will go viral, gain followers, or achieve any specific result.

8.3 Your Responsibility

You are solely responsible for:

• Reviewing and editing AI-generated suggestions before publishing
• Ensuring your published content complies with platform guidelines and applicable laws
• Any consequences of publishing content based on our suggestions
• Verifying the accuracy of any claims, statistics, or facts in AI-generated content

9. Intellectual Property

9.1 Your Content

You retain all ownership rights to:

• Audio and video recordings from your sessions
• Notes and content ideas you create
• Content you publish based on our suggestions

By using the Service, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the Service to you. We do NOT claim any ownership over your content.

9.2 Our Content

MyDirector AI retains all rights to:

• The Service's software, algorithms, and infrastructure
• UI design, branding, and visual elements
• Research methodologies and analysis frameworks
• Documentation and marketing materials

9.3 No Model Training

We do NOT use your personal data, recordings, transcripts, or content to train, fine-tune, or improve AI models. Your data is used exclusively to provide the Service to you.

10. Subscription and Billing

10.1 Paid Plans

The Service may offer paid subscription plans with enhanced features. By subscribing to a paid plan, you agree to:

• Pay the applicable fees as displayed at the time of purchase
• Authorize recurring charges at the selected billing interval
• Provide accurate billing information

10.2 Payment Processing

All payments are processed by Stripe, Inc. We do not store your full payment card details. Payment processing is subject to Stripe's terms of service and privacy policy.

10.3 Billing Cycle

Subscriptions are billed in advance on a recurring basis (monthly or annually, as selected). Your subscription will automatically renew unless canceled before the next billing date.

10.4 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation:

• You retain access to paid features until the end of your current billing period
• No refunds are provided for partial billing periods
• Your account reverts to the free tier after the paid period ends

10.5 Refund Policy

Refunds may be issued at our sole discretion. If you believe you were charged in error, contact us at hello@mydirector.ai within 14 days of the charge.

10.6 Price Changes

We reserve the right to change pricing at any time. Existing subscribers will receive at least 30 days' notice before price changes affect their subscription.

11. Account Termination

11.1 By You

You may delete your account at any time through the app settings. Account deletion requires re-authentication with your current password. Upon deletion:

• Your profile data, notes, and research are deleted immediately
• Interview recordings are retained for 90 days, then permanently deleted
• A deletion audit log is maintained for compliance purposes

11.2 By Us

We may suspend or terminate your account if:

• You violate these Terms of Service
• You engage in abusive or fraudulent activity
• Your account has been inactive for an extended period (12+ months)
• Required by law or legal process

We will make reasonable efforts to notify you before termination, except in cases of severe violations or legal requirements.

12. Limitation of Liability

13. Indemnification

You agree to indemnify and hold harmless MyDirector AI Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you create or publish based on the Service's suggestions

14. Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

14.2 Informal Resolution

Before filing any legal claim, you agree to attempt to resolve disputes informally by contacting us at hello@mydirector.ai. We will attempt to resolve the dispute within 30 days.

14.3 Jurisdiction

Any legal action arising from these Terms shall be brought exclusively in the state or federal courts located in the State of Delaware. You consent to the personal jurisdiction of these courts.

15. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes:

• We will update the "Last Updated" date at the top of this page
• We will notify registered users via email for significant changes
• Continued use of the Service after changes constitutes acceptance

If you do not agree with updated Terms, you must stop using the Service and delete your account.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and any additional agreements you enter into with us, constitute the entire agreement between you and MyDirector AI Inc. regarding the Service.
